Terms of Service
1.0 Company Overview
1.1 Set It Aside (hereby referred to as SIA) is a materials brokering company who picks up, sorts, weighs, and gets customers the best price for all recyclable materials. SIA charges a percentile based fee at the completion of the service as noted below. SIA goals include helping local economies, schools, worthwhile causes, displaced families who are not homeless by choice, and environmentally sensible developers through fiscal, physical, marketing, and experience.
1.2 SIA is not a recycler in any form, and does not have a vested interest in any state certified recycling center as this may cause unfair representation to clients. Rather, SIA acts on behalf and represents clients as owners of their materials.
1.3 At no point is SIA the owner of clients' materials any more than a Real Estate broker is the owner of the seller’s home. SIA is an acting owner on behalf of clients only to the legal requirement of helping the owner of the materials to sell their goods.
2.0 Service Agreement
2.1 I hereby request SIA to broker my materials. I understand that I will be provided with bags and/or containers as are available or warranted solely at the discretion of SIA. I may utilize my own bags or containers as well. I understand that any bags or materials must be placed separately of any and all city, county, or otherwise owned receptacles for pickup.
2.2 I authorize SIA to enter my property for the sole purpose of picking up my materials in bags and containers for the intent of selling my materials. I understand that SIA representatives will not enter my home, vehicles, sealed containers, or any area where they believe a potential safety or health hazard may be present. SIA representatives will only enter gated areas as requested by me, or to access my materials as necessary. In cases where special pickups are requested for construction materials, salvage materials, or other materials other than post consumables, SIA is at discretion as to whether or not a pickup is deemed acceptable.
2.3 I understand and agree that SIA is not responsible for any materials which are stolen, lost, vandalized, or unable to be credited due to providing potential health or safety hazards due to contamination, breakage, unknown substances, medical waste, and biohazard materials
2.4 I understand that I am the sole owner of my material and that at no point is SIA the owner of my materials but may instead act only as the representative of the legal owner only to the extent of turning in my materials on my behalf. I authorize SIA to act on my behalf as the legal owner of my materials solely for the purpose of sale or transfer of my materials.
3.0 Payment
3.1 I understand that SIA will combine my materials with the materials of other customers in order to get the best price for my materials. This may mean a mingling of my materials with the materials of others to meet minimum quotas set by purchasers.
3.2 I allow SIA to hold my money until an amount is reached wherein SIA can be paid a minimum of $15.00 for their broker’s fee.
3.3 Once I have accumulated a total of $30.00 in material SIA will issue me payment within no more than 30 days minus a 50% brokers fee that I agree to be retained from my total and paid to SIA.
3.4 If I decide to donate a portion of my funding directly to an approved organization such as a school, church, nonprofit, or cause, I understand that the payment I give will be out of my final total and will not count towards any fees payable to SIA.
3.5 I agree SIA is not responsible for any payments lost, misplaced, or undeliverable due to a change in address, theft, or other unforeseen circumstance.
4.0 Material Pricing
4.1 I understand that SIA will attempt to procure the best price for my materials but is not held to any guaranteed price unless otherwise stated.
4.2 I understand that any material I give that is contaminated or is placed within a container that is contaminated, will not be counted to my totals. Contamination includes, but is not limited to, rotted organic materials, fermented liquids, household chemicals, hazardous household waste, body fluids, or unknown powders, liquids, or anything else which may pose a danger or concern to SIA.
5.0 Changes
5.1 I understand that it is my responsibility to keep up to date to any changes in materials, procedures, terms of service, and any other factors which may be posted by SIA and that SIA is under no obligation to notify me of any and all changes that may affect my service.
6.0 Termination
6.1 I understand that I am under no obligation to continue to utilize SIA and at any point may request full payout, return of my unpaid materials, or a combination thereof. I understand that if either party terminates the service, SIA has up to 90 days to issue final payment or return of materials at their discretion.
6.2 I understand that SIA may cancel my service for inactivity, providing hazardous or excess non recyclable materials, risk of safety to drivers, staff, or any other SIA personnel, or any other reason provided by SIA.
